Terms & Conditions/Refunds

While accessing TrainingConsortium, you agree by default with the terms and conditions below. Before accessing this service, you should read this agreementcarefully. By accessing this service, you agree to be bound by the terms and conditions below.

Use of TrainingConsortium and the Internet

You understand that you may access both TrainingConsortium and the Internet in general through this service. You understand further that, except for information, products or services clearly identified as being supplied by TrainingConsortium, neither TrainingConsortium nor any of its affiliates operates or controls any information, products or services on the Internet in any way and that except for TrainingConsortium-identified information, products or services, all merchandise, information and services offered or made available through TrainingConsortium or the Internet generally are offered or made accessible by third parties who are not affiliated with TrainingConsortium nor its affiliates.

You assume total responsibility and risk for your use of TrainingConsortium and the Internet. Neither TrainingConsortium nor its affiliates make any express or implied warranties, representations or endorsements whatsoever (including without limitation warranties of title or non-infringement, or the implied warranties of merchantability or fitness for a particular purpose) with regard to any merchandise, information or service provided through TrainingConsortium or on the Internet generally. Further, neither TrainingConsortium nor its affiliates shall be liable for any cost or damage arising either directly or indirectly from any such transaction. It is solely your responsibility to evaluate the accuracy, completeness and usefulness of all opinions, advice, service(s) and other information, and the quality and merchantability of all merchandise, provided through TrainingConsortium or the Internet generally.

You understand further that the Internet contains unedited materials some of which are sexually explicit or may be offensive to you. You access such materials at your own risk. TrainingConsortium has no control over and accepts no responsibility whatsoever for such materials.

No Service Warranties

This service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of title, non-infringement or implied warranties of merchantability or fitness for a particular purpose. Neither TrainingConsortium nor its affiliates warrants that the service will be uninterrupted or error free, or that any information, software or other material accessible on this service is free of viruses or other harmful components.

Under no circumstances shall TrainingConsortium, its affiliates or its contractors be liable for any direct, indirect, incidental, special, punitive or consequential damages that result in any way from your use of or inability to use this service or to access the Internet or any part thereof, or your reliance on or use of information, services or merchandise provided on or through this service or that result from mistakes, omissions, interruptions, deletion of files, errors, defects, delays in operation or transmission, or any failure of performance.

If you are dissatisfied with this service or with any terms, conditions, rules, policies, guidelines, or practices of TrainingConsortium in operating this service, discontinue using this service.

Multiple Listings

Multiple listings within a single organization will be recognized and processed only when completed by the individual who represents that specific listing. TrainingConsortium reserves the right to withhold all requests for registration when multiple listings appear for a single organization. Multiple listings include, but are not limited to, product or service listings from agents, brokers, clearinghouses, sponsors, publishers, entertainment managers, umbrella organizations, bureaus, associations, and representatives. Such organizations may register only as a single entity as a vendor, while individual listings must be completed by and credited to the individual trainer, consultant, speaker or author.

User Conduct on the Service

While using this service, you may not::

  • Restrict or inhibit any other user from using and enjoying the Internet.
  • Post or transmit any unlawful, threatening, abusive, libelous, defamatory, obscene, pornographic, profane, or otherwise objectionable information of any kind, including without limitation any transmissions constituting or encouraging conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any local, provincial, federal or international law.
  • Upload onto this service materials (e.g. text, programs, products, and images) which are protected by copyright (as provided by US federal law and by international treaties) without the express permission of the copyright holder. Copyrighted materials may be downloaded for personal use. Except as expressly permitted, materials under copyright may not be distributed to others. Copyrighted materials may not be changed, nor can the author attribution notices nor the copyright notices be modified.

Consumer Information

You understand and agree that unless you notify TrainingConsortium to the contrary by e-mailing Dispute@TrainingConsortium.com, TrainingConsortium may publish your name and other consumer information in one or more directories which may be accessed by other Internet users. In addition, unless you notify TrainingConsortium to the contrary as provided above, TrainingConsortium may make such information available to third parties from time to time. You understand further that merchants on TrainingConsortium may have access to such information and may make it available to third parties in accordance with their normal practices unless you notify those merchants directly that you do not wish such information to be made available.

By registering and/or using TrainingConsortium, you agree to receive e-mails on a periodic basis regarding your registration or site announcements, and understand that upon your written request, you may terminate any additional correspondence.

Failure to Comply with Terms and Conditions

TrainingConsortium may deny you access to all or part of this service without notice if you engage in any conduct or activities that TrainingConsortium in its sole discretion believes violates any of the terms and conditions in this Agreement. If TrainingConsortium denies you access to this service because of such a violation, you shall have no right (1) to access through TrainingConsortium any materials stored on the Internet, (2) to access third party services, merchandise or information on the Internet through TrainingConsortium, and TrainingConsortium shall have no responsibility to notify any third-party providers of services, merchandise or information nor any responsibility for any consequences resulting from lack of notification.

You agree to defend, indemnify and hold TrainingConsortium and its affiliates harmless from any and all liabilities, costs and expenses, including reasonable attorneys' fees, related to any violation of this Agreement by you or authorized users of your account, or in connection with the use of this service or the Internet or the placement or transmission of any message, information, software or other materials on the Internet by you or authorized users of your account.

Miscellaneous

In the event that any portion of this Agreement is held to be unenforceable, the unenforceable portion shall be construed in accordance with applicable law as nearly as possible to reflect the original intentions of the parties and the remainder of the provisions shall remain in full force and effect.

TrainingConsortium's failure to insist upon or enforce strict performance of any provision of this Agreement shall not be construed as a waiver of any provision or right. Neither the course of conduct between parties nor trade practice shall act to modify any provision of the Agreement.

TrainingConsortium may modify this Agreement from time to time by e-mailing a notice of such modification to our registered users, and your continued use of this service following notice of such modification shall be deemed to be your acceptance of any such modification. If you do not agree to any modification of this Agreement, you must immediately stop using this service.

This Agreement shall be governed by and construed in accordance with the laws of the State of Massachusetts and the United States of America, without regard to its conflicts of law provisions. Any cause of action you may have with respect to this service must be commenced within one (1) year after the claim or cause of action arises or such claim or cause of action is barred.

This Agreement constitutes the entire agreement between you and TrainingConsortium with respect to this service. All Policies and Procedures found within this site apply to both the particular page and to the site in its entirety.

Payment Terms

TrainingConsortium accepts Visa, MasterCard, American Express, Discover, and Diners Club as the payment options for your purchase.

Terms of Service for Credit Card Purchases:

The term "credit card holder" as used in these terms and conditions is defined as the person or entity in whose name the credit card was issued by the bank or financial institution that appears on the credit card. When you complete a purchase online using a credit card for payment, you agree to the following terms and conditions:

  • You are the credit card holder, a representative of the credit card holder or the credit card holder is aware you are making the purchase and has authorized you in advance to make the purchase using their credit card.
  • If you are not the credit card holder, you agree to notify the credit card holder of the purchase before making the purchase, and you guarantee to TrainingConsortium that you have made the credit card holder aware of the purchase in advance.
  • If you have a problem with your purchase, you will contact TrainingConsortium to allow us to resolve the problem before contacting either the financial institution that issued the credit card or the credit card company.
Refund Terms
  • You must notify TrainingConsortium of your request within 3-5 business days.
  • TrainingConsortium will issue a credit or refund within 3-5 business days of an approved request or cancellation.
  • TrainingConsortium will charge back the total amount of this approved cancellation within 3-5 business days minus a $25.00 transaction fee.
  • TraininConsortium will not provide refunds beyond 3-5 business days after your purchase date.

Credit Card Chargebacks

TrainingConsortium is proud to say that we have never once had a customer rightfully chargeback a purchase made online. All requests to negate charges are investigated by our technical and legal departments. Request a credit or refund.

TrainingConsortium reserves the right to modify this Refund Policy at its discretion, or against any customer it believes is abusing this policy. Any such revision or change will be binding and effective immediately after posting of the revised Refund Policy on TrainingConsortium's Web site. You agree to periodically review our Web sites, including the current version of our Refund Policy. Our refund policy is made available on our Web site. It is your obligation to review our refund policy for any such revisions.
